Welcome to The Crimson Market, operated by 4Traders Pty Ltd (ABN: 82 670 487 813). These Terms and Conditions apply to users of our platform, community features, memberships, giveaways, rewards, software tools, digital products, physical products, computer sales, computer building services, partner promotions, and related brand and creator services.

1. Our Business, Brand and Services

The Crimson Market is a gaming, creator, technology, and commerce brand. We promote our brand, our content, our social channels, our products, our partners, and our related software services through our website, social media, livestreams, giveaways, events, and partner network.

We create and publish brand, community, promotional, educational, and entertainment content across our channels and communities. We also build, design, configure, and sell custom computers, offer computer-related services, sell digital products and in-game items, and provide software tools, AI-powered features, and token-based digital services for our users and communities.

Our giveaways and reward campaigns are used to reward members of The Crimson Market community, support audience engagement, and help produce content and related commercial activity. We also promote third-party businesses through our marketing, sponsorship, and partner services, including featured businesses, creators, and campaigns presented through our platform.

Some parts of our software use Lucky Points, tokens, credits, or similar digital balances to unlock, access, or interact with certain platform, AI, or software-based functions. We may change, expand, remove, or rebalance these systems over time.

2. Our Marketing Content

The Crimson Market creates and distributes marketing, promotional, community, educational, and entertainment content in connection with our brand, our products, our partner businesses, our events, our software services, and our broader commercial activities.

Our content may relate to partners, featured businesses, products, services, giveaways, livestreams, sales activity, events, software tools, and general brand promotion. That content may also be viewed by members of the public who are not customers, members, or partners, including people reviewing or interacting with our content for their own purposes.

Our marketing content is not directed to children and is not created for children. If any of our marketing content is seen by children, that is not the intended audience. Parents and guardians are responsible for supervising minors' access to online platforms, social media accounts, livestreams, and related digital content.

3. Eligibility

The Services are not intended for individuals under the age of 18 or below the minimum age of digital consent, as applicable. By accessing or using the Services, you affirm and agree that:

  • (i) you are 18 years of age or older, or you have reached the minimum age of digital consent in your country;
  • (ii) if you are of legal age or above the age of majority in your jurisdiction, you have read, understood, and accepted these Terms; and
  • (iii) if you are between the ages of 18 (or the minimum age of digital consent, as applicable) and the age of majority in your jurisdiction, your legal guardian has reviewed and agreed to these Terms. If we become aware of the Services being used by a child under the age of 18 or the minimum age of digital consent, we reserve the right to terminate their access to the website and the services.
  • (iv) overseas users are responsible for ensuring that their participation does not contravene the laws of their country of residence.

4. Privacy

Our Privacy Policy is an integral part of these terms and conditions. For detailed information on the collection, use, and sharing of user information through our Services, please refer to our Privacy Policy.

5. Your Account

You are responsible for the security and integrity of your login credentials, any information provided by you, and any actions taken using your Account within the Services. Registering multiple Accounts on the Services, whether in your name or not, is prohibited. By registering, you confirm that the information provided to us is truthful, accurate, up-to-date, and complete. We reserve the right to reject any username or to terminate or prevent the use of a username at our discretion. Safeguarding the confidentiality of your login credentials is your responsibility, and you are liable for all activities carried out using your credentials or Account. If you suspect any unauthorized use of your Account or a breach of your login credentials' confidentiality, you agree to promptly notify us. We will not be held liable for any losses or damages arising from unauthorized use of your credentials.

6. Memberships, Support, Lucky Points and Free Giveaways

Memberships, subscriptions, paid packages, and other paid features on The Crimson Market are intended to support our work as content creators, community operators, software providers, sellers, marketers, and technology builders.

Payments made to The Crimson Market support our content production, livestreams, social media activity, community operations, software development, AI services, custom computer design and build work, product sourcing, partner marketing, events, and related services. Payment is not a requirement to be in our giveaways, because users may join and participate through free pathways where offered.

Our giveaways are community rewards, engagement tools, and content activations. Paid memberships, Lucky Points, software access, platform perks, tokens, discounts, and supporter features relate to broader supporter benefits, digital services, and community access, and not to the purchase of giveaway eligibility itself.

Lucky Points are used across different parts of our ecosystem for rewards, visibility, platform status, or feature access, and may be earned, allocated, adjusted, withheld, expired, or removed in accordance with these Terms, platform rules, fraud controls, account status, and the specific feature involved.

7. Fair Reward Selection Process

Intent and Fairness:

Our reward selection processes are designed with the primary intent of ensuring fairness, consistency, and compliance, while avoiding any resemblance to a lottery, raffle, or other prohibited chance- based system.

Selection Criteria:

Reward decisions may take into account Lucky Points, community participation, platform activity, account status, compliance factors, promotional conditions, and other criteria we determine from time to time for the relevant reward, feature, or campaign.

Reward outcomes may be assisted by internal tools, structured review processes, automated systems, Large Language Models, content creators, moderators, or administrators, depending on the nature of the relevant reward or activation.

Non-Discrimination:

We are committed to a non-discriminatory approach. No member of the family or an associate of an employee shall receive any unfair advantage in the reward selection process.

Right to Modify:

We reserve the right to modify the Fair Reward Selection Process, including changes to how Lucky Points function, how rewards are assessed, and the introduction, removal, or adjustment of reward categories, qualification criteria, or internal processes. Any modifications may be communicated in advance where reasonably practicable.

Compliance with Laws:

Our Fair Reward Selection Process is intended to comply with all relevant laws and regulations and is structured so as not to constitute a sweepstake, drawing, chance game, lucky draw, game of chance, gambling event, random prize allocation, hazard game, draw of lots, prize draw, or other prohibited chance-based competition.

8. Cancellations and Refunds

You may cancel your membership at any time through your account dashboard. Unless otherwise stated in these Terms, cancellation of a paid membership will stop future renewals but does not automatically refund payments already processed.

  • (a.) Subscribers can follow the instructions provided in the confirmation email to manage their subscription directly on the profile page.
  • (b.) How to Cancel Via PayPal: Subscribers can cancel their subscription in their PayPal recurring payments settings.
  • (c.) How to Cancel Via Stripe: Subscribers can cancel their subscription in their Stripe customer dashboard.
  • (d.) How to Cancel Crimson Market Monthly Subscription:
    1. Login to your account on The Crimson Market website.
    2. Click on your profile name.
    3. Click on Account Settings.
    4. Click on Manage Subscription.
    5. Click Cancel Subscription on the subscription you wish to cancel.
  • (e.) Forgotten Membership Details: If you subscribed with PayPal or Stripe and can no longer remember which account details you used, use our membership recovery page to request a recovery email sent to your billing email address.

Refund requests are assessed under our refund eligibility rules. To be eligible for a refund, the relevant subscription payment must have been made within the previous seven (7) days and must have been made after the most recent completed large reward or giveaway. Payments made before the most recent completed large reward or giveaway are not eligible for refund.

If a refund is approved, The Crimson Market may deduct the Lucky Points, tokens, credits, or related platform benefits granted by the refunded payment from your account. Other balances not granted by the refunded payment may remain on your account, subject to these Terms and your account status.

One-time packages, bonus Lucky Points, promotional Lucky Points, referral rewards, digital goods, delivered services, and balances connected with a completed or already-used feature may be non-refundable unless required by applicable law.

Submitting a refund request does not guarantee approval. If you believe your payment qualifies, you can submit your request using our refund flow.

Refund Me

Refunds beyond the 7-day notice period are at our discretion and may not be possible where Lucky Points, software access, or related benefits have already been used, counted, consumed, or allocated.
Credit Card Security: We do not store credit card information. Payment data is stored within providers such as PayPal or Stripe.

Nothing in these Terms limits any rights you may have under Australian Consumer Law or other applicable consumer protection legislation.

9. Reward Eligibility and Account Status

Paid Subscription Period:

Paid memberships may provide supporter benefits and account status during the paid period, but payment itself is not required to be in our giveaways where free pathways are available.

Cancellation Does Not Terminate Paid Period:

Canceling a subscription does not automatically terminate the already-paid period. Where applicable, users who have an active period at the time of reward selection may still remain eligible subject to account status, compliance checks, and any specific promotion rules.

Open Rewards:

Rewards may be open to all eligible users, including free users, regardless of payment status or subscription cancellation, if that is how the relevant reward is structured.

Failed Payment Honoring:

In the event that a subscription payment fails during the reward selection process, we understand that unforeseen issues may arise. As such, we may honor the eligibility of the user if the payment is made within 5 days of the failed transaction. However, the final decision regarding eligibility will rest with the company's directors or administrators.

Director's Discretion:

The ultimate decision regarding a user's eligibility for a reward, even in cases of failed payments, suspicious activity, platform misuse, or account disputes, rests with the company's directors or authorized administrators. Their judgment on eligibility is final, subject to applicable law.

Unclaimed Rewards:

If a selected member is unable to accept a reward for any reason, it is at the discretion of the directors to choose an alternative candidate. This decision will be made in the best interests of the company and its subscribers.

Abandoned Rewards:

A reward will be considered abandoned if the selected member cannot be contacted within 2 weeks of the reward announcement. In such cases, the directors will determine whether to reassign the reward to another eligible member.

10. Trademarks

At 4Traders, we proudly own and protect the trademark associated with our brand. This distinctive trademark serves as a symbol of our commitment to delivering exceptional products and services to our valued customers. Our trademark represents the culmination of our innovative ideas, meticulous craftsmanship, and unwavering dedication to excellence. With our exclusive ownership of this trademark, we ensure that our customers can confidently identify and trust the quality and reliability of our offerings. We remain steadfast in our responsibility to safeguard and enforce our trademark rights, reinforcing our position as a trusted leader in the industry. Any references to third-party games, platforms, publishers, products, or services do not imply endorsement unless expressly stated by us.

11. Legal Jurisdiction and Applicable Laws

4Traders Pty Ltd (ABN: 82 670 487 813) operates under the following jurisdiction and applicable laws:
Legal Jurisdiction: All legal matters, disputes, and issues related to 4Traders Pty Ltd shall be subject to the legal jurisdiction of Victoria, Australia. Any legal action, arbitration, or resolution shall be conducted in accordance with the laws of the state of Victoria.
Applicable Laws: The company, 4Traders Pty Ltd, is bound by and shall operate in compliance with all relevant and applicable federal and state laws of Australia, as well as any industry-specific regulations that pertain to its business operations. This includes but is not limited to laws related to business, commerce, taxation, and consumer rights.
By using our services, engaging with our website, or entering into any business transactions with 4Traders Pty Ltd, you acknowledge and agree to the legal jurisdiction and laws stated herein. Any disputes or legal actions shall be resolved in accordance with the jurisdiction and laws specified above.

We may refer enquiries, complaints, formal demands, regulatory correspondence, and legal assertions to our internal or external legal advisers for review. Our legal and compliance advisers assist us in monitoring applicable legal requirements and maintaining compliance across our business operations. We are not required to provide a substantive response to every enquiry unless we consider a response necessary, appropriate, or legally required. Where we determine that a matter raises a serious legal, regulatory, or evidentiary issue, we may reserve all rights, respond through legal representatives, and address the matter through the appropriate court, tribunal, regulator, or other formal dispute resolution process.
